1. Platform Access and Use

1.1. Eligibility:

You must be at least 18 years old and legally capable of entering into a binding agreement to access and use the Platform.

1.2. Account Registration:

To access certain features of the Platform, you may be required to create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Service Requests and Transactions

2.1. Service Requests:

You may use the Platform to request roadside assistance services from certified automotive professionals ("Partners"). By submitting a service request, you agree to pay the applicable fees for the services rendered by the Partner.

Quality Supervision : You must supervise the quality of the work performed by the Partner while the service is being provided. You are expected to be present during the service to monitor and ensure all requested work is completed satisfactorily.

2.2. Payment Processing:

Payments for services rendered by Partners are processed through third-party payment gateways. By making a payment on the Platform, you authorize Bharat Mechanic to facilitate the payment transaction on your behalf.

2.3. Service Completion:

Once the requested services are completed by the Partner, you agree to provide feedback and ratings based on your experience. Bharat Mechanic reserves the right to suspend or terminate your access to the Platform for repeated misconduct or violations of these Terms & Conditions.

Immediate Reporting : You must report any issues, concerns, or dissatisfaction with the service immediately during or upon completion of the service to both the Partner and Bharat Mechanic.

3. Partner Services

3.1. Partner Qualifications:

Bharat Mechanic verifies the qualifications and certifications of Partners registered on the Platform. However, we do not guarantee the quality or suitability of services provided by Partners and disclaim any liability for their actions or omissions.

3.2. Data Security Disclaimer:

While Bharat Mechanic encourages Partners to ensure the security of any data shared with them, we cannot guarantee the security of such data. You acknowledge and agree that any information you provide to Partners is at your own risk, and Bharat Mechanic disclaims any liability for the actions or omissions of Partners regarding your data.

4. Intellectual Property

4.1. Ownership:

The Platform and its content, including but not limited to text, graphics, logos, and images, are owned by Bharat Mechanic and protected by copyright and other intellectual property laws.

4.2. Limited License:

Subject to these Terms & Conditions, Bharat Mechanic grants you a limited, non-exclusive, and non-transferable license to access and use the Platform for your personal, non-commercial purposes.

5. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BHARAT MECHANIC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

BHARAT MECHANIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms & Conditions shall be resolved through arbitration in Surat, Gujarat, in accordance with the Indian Arbitration and Conciliation Act, 1996.

We may update these Terms & Conditions from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by posting the updated terms on the Platform or by other means.
